By using this Website or by requesting the purchase of any product and/or service, the user agrees to these Terms. The user is informed that these Terms may be modified, and the user is solely responsible for reviewing them upon each access, browsing and/or use of the Website. Only the version in force at the time of requesting the product and/or service will apply.
If you require more information or wish to resolve any doubts regarding these Terms, you can always write to the contact address indicated at the beginning of these Terms.
In all cases, the user declares that they are over 18 and have the legal capacity to enter into contracts/purchases through this Website. The user also assumes responsibility for correct use of the Website, and in no case may:
- Make fraudulent purchases.
- Provide contact details falsely or unlawfully.
2) Purpose and Scope
These General Terms and Conditions of Contract (GTC) regulate the online purchase, by interested parties and/or customers, of experiences and events offered by LA PONTEZUELA SLU, which will take place both at its estate and at the olive mill.
Experiences must be paid in full in advance.
Payment implies awareness and full acceptance of these GTC, as well as of the Privacy Policy published on the website and accessible to all interested parties.
Reservations will only be effective once the slot is confirmed.
3) Electronic Contracting Process
Experiences are always contracted electronically.
Illustrative contracting flow:
- Select the experience page.
- Select the desired number of seats and time.
- Go to the cart.
- Enter the requested details.
- After accepting the general terms and the privacy notice, proceed to payment. The prospective attendee may correct errors before payment (edit the cart or go back).
- After payment, you will receive a confirmation by email.
Points to note:
- A summary notice of the general terms appears on the seat/time selection screen of each experience.
- Express acceptance: before proceeding to payment, it is mandatory to tick the boxes accepting these GTC (with explicit information on cancellation and the absence of a right of withdrawal) and the Privacy Policy; marketing consent is always optional and at the discretion of the interested party.
- Confirmation: after payment, the purchaser receives a confirmation email with a summary of the purchase and a link to these GTC, which remain available on a specific page.
4) Prices, Taxes, Invoicing and Payment Methods
Prices are always shown including VAT. There are no additional charges unless expressly indicated in the experience page.
Payment methods: Card (Redsys), PayPal and/or bank transfer (subject to published availability).
All operations involving the transmission of personal or banking data are carried out in a secure environment using a server based on standard SSL security technology, so that all information is transmitted encrypted across the network. In cases where payment is made by credit card, card data are entered directly on the financial entity’s page, the bank’s Point of Sale Terminal (POS), and are not entered on any LA PONTEZUELA, SL server, nor are such data recorded.
Payments made via VISA or MasterCard always require the following data: card number, expiry date and validation code, which corresponds to the three digits on the back of the VISA or MasterCard.
If paying by bank transfer, you must indicate the order number, full name and surname(s) in the subject line, and make the transfer within three days after the order confirmation date for validation. Payment must be made in euros. The customer is responsible for any bank or exchange fees. For bank transfers made outside Spain, you must inform your originating bank that you will bear bank fees and expenses; otherwise, LA PONTEZUELA, SL may hold the shipment of your order because the full amount was not received, and therefore the agreement is not deemed fulfilled (Article 1255 of the Spanish Civil Code).
PAYPAL – Enter your credentials and complete the purchase easily. Using this payment system does not require the customer/user to have a registered PayPal account. In any case, you can pay by selecting this option. Once the purchase process begins, you will be redirected to PayPal’s payment gateway, where two options are available: (i) if you have an account, log in and pay with your registered data; (ii) if you do not have an account, enter your card details and pay instantly with no commission.
Invoicing: a simplified invoice is issued by default and a full invoice is available upon request.
5) Date and Attendance. Right of Withdrawal
Services are provided on specific dates and times, as selected by the Customer during the contracting process. For leisure activities with a specific date or time, the right of withdrawal does not apply (art. 103.l of the Spanish Consolidated Consumer Law). Therefore, the right of withdrawal does not apply in any case. This is clearly communicated prior to contracting.
6) Cancellations, Changes and Refunds
Cancellations of the “experience” products offered may be made either by customers/interested parties or, exceptionally, by LA PONTEZUELA, SLU itself.
6.1 If the customer cancels
- 72 hours or more in advance: if the customer gives at least 72 hours’ notice of their inability to attend the contracted experience, they may choose either a full refund or a date change (up to 1 change at no cost unless otherwise indicated on the experience page).
- Between 72 and 24 hours: if the customer gives less than 72 hours’ notice but at least 24 hours before the service, a date change will be offered (no refunds).
- Less than 24 hours or no-show: if the customer gives less than 24 hours’ notice or does not attend the contracted experience, no date change or refund will be offered.
6.2 If the organiser cancels
On certain occasions, cancellation may be made by LA PONTEZUELA SLU. Cancellation may be due to: (i) failure to reach the minimum number of participants; and (ii) adverse weather conditions for experiences held outdoors or requiring good weather. In such cases, the company will inform the Customer with sufficient notice of the impossibility of providing the service and will proceed to refund the full amount paid by the Customer within the legally applicable time limits.
If, after the minimum number of participants is reached and the Service is confirmed, subsequent withdrawals reduce the total below the required minimum, the company may also cancel the Service and refund the full amount paid.
For other reasons, the Customer may choose a full refund or change/voucher, at the customer’s discretion. Vouchers will be valid for 6 months and are not redeemable for cash. Coupons, if any, are not cumulative.
6.3 No Cancellation Insurance
LA PONTEZUELA, SLU does not offer cancellation insurance, and these terms are the only ones applicable regarding date changes or refunds.
6.4 Refund Process
Where applicable, refunds will be made within a maximum of 14 calendar days and by the same means of payment used for the purchase.
6.5 Transfer of Tickets
Changing the name on a reservation is allowed up to 24 hours before the start (no option to change the date).
7) Participation and Access Rules
Customers must arrive 15 minutes before the start of the contracted experience. Parking access will be public and free at the facilities.
Minors: minors must be accompanied by an adult; for activities involving alcohol, only those over 18 may attend.
Pets: pets are not allowed to attend experiences.
Right of admission: access may be denied due to non-compliance with safety rules, offensive conduct or intoxication, with no right to a refund.
Production facilities: Customers must respect restricted areas and staff instructions; otherwise, LA PONTEZUELA, SLU may remove Customers from the contracted experiences. Comfortable footwear is recommended.
Grace period: Customers are granted a 10-minute grace period from the scheduled start time of the experience; after the grace period has elapsed, LA PONTEZUELA, SLU may deny access with no right to a refund.
8) Force Majeure and Changes by the Organiser
Modifications may occur due to force majeure (adverse weather, breakdowns, trainer unavailability, strikes, health restrictions, supply cuts, agricultural incidents). You will be notified as soon as possible using the contact methods provided in advance for this purpose (email/SMS/WhatsApp). In such cases, the option will be offered to choose between a date change, a voucher for another product/experience, or a refund as applicable to the type of experience contracted.
9) Intellectual Property
The materials provided (guides, sheets, dossiers, presentations, etc.) are protected; reproduction without authorisation from LA PONTEZUELA, SLU is prohibited.
10) Data Protection and Image Rights
The data provided by the Customer when contracting “experiences” will be processed by LA PONTEZUELA, SLU (registered office at C/ Conde de Peñalver 45, 28006, Madrid) as the data controller and always in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR), Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights, and other applicable laws.
Personal data will be processed by the Controller for the following purposes: (i) to manage the reservation and the provision of the contracted experience, (ii) to comply with legal obligations, and (iii) where applicable, to create promotional audiovisual material, but always with the customer’s prior express authorisation and consent.
The legal basis for processing personal data will be the performance of the contract for the management of the experience, compliance with legal obligations, and the data subject’s consent for capturing and disseminating their image. The collected data may be disclosed to public authorities and bodies to comply with legal obligations, and to banking entities necessary to carry out such management. Data will be kept as long as the contractual relationship lasts and for the time limits established to meet applicable legal requirements. Once those periods have ended, the data will be blocked for the statutory limitation periods and subsequently deleted. No international data transfers will be carried out.
To exercise the rights of access, rectification, erasure, objection, portability and restriction of processing, a written request identified with the reference “Data Protection” must be sent, specifying the request concerned and properly identifying the data subject, to LA PONTEZUELA, SLU’s registered office or to protecciondedatos@lapontezuela.com. If you consider that your rights have been violated, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
Images and recordings: During the experiences, photographs and audiovisual recordings may be made for promotional purposes and dissemination on the corporate website and social media. The image of attendees will be used only when they have previously given their express consent through the corresponding authorisation. Refusal to grant such consent will not condition participation in the contracted experience.
11) External Providers
For the proper development of certain activities included in the experiences, LA PONTEZUELA, SLU may collaborate with specialised external providers or companies (for example, escape room experts, monitors, transport companies, catering or other complementary services).
When such companies act in the execution of services integrated into the contracted experience, they will do so under their own technical and professional responsibility.
LA PONTEZUELA, SLU will be liable to the customer for the proper overall provision of the contracted service.
The Company will not be liable for:
- Acts or omissions attributable exclusively to the external provider when it acts with full organisational and technical autonomy.
- Damage resulting from incorrect information provided by the participant.
- Force majeure situations or unforeseeable and unavoidable circumstances.
In all cases, external providers must hold the administrative authorisations and insurance required by the applicable regulations.
12) Contractual Integration and Order of Precedence
These General Terms, together with the Specific Conditions of each experience incorporated as an Annex to this contract, constitute the entire agreement between the parties.
The Specific Conditions of each experience form an integral part of the contract from the moment of contracting.
In the event of any conflict between these General Terms and the provisions of the Annex corresponding to the contracted experience, the provisions of that Annex shall prevail as specific conditions applicable to that particular activity.
All of the above is without prejudice to the mandatory application of consumer and user protection regulations.
13) Governing Law and Jurisdiction
These Terms shall be governed by Spanish law.
In the event of a dispute, where the customer is a consumer, the Courts and Tribunals of the consumer’s domicile shall have jurisdiction in accordance with current regulations.
If the contracting party is not a consumer, the parties submit to the Courts and Tribunals of Toledo, expressly waiving any other jurisdiction that may correspond to them.
Annex I – Specific Conditions by Experience
This Annex regulates the specific conditions applicable to each experience.
These conditions supplement and further develop the General Terms and Conditions of Contract, prevailing over them in the event of any contradiction.
A) Recurring Experiences
1) Oleotourism visit: approximately 90 minutes. The experience includes a visit to the Interpretation Centre, access to the immersive Virtual Reality room, access to the “360° room”, and participation in the EVOO tasting.
Minimum number of participants required: 1.
Cancellation policy for this experience: If the Customer gives at least 72 hours’ notice, a refund will be provided or a date change will be offered; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered (no refund). If the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
If cancellation is by LA PONTEZUELA, SLU, the Customer will be offered a refund/date change or validation of a voucher. Change window: 6 months.
If cancellation is by LA PONTEZUELA SLU, the conditions set out in the body of the General Terms and Conditions of Contract shall apply.
2) Lunch: the lunch slot will last 90 minutes. Lunch will include the published menu (via social networks), which the Customer will have access to (through the booking confirmation email).
Minimum participants: 1.
Cancellation policy for this experience: If the Customer cancels more than 72 hours in advance or up to 72 hours before, a refund of the amount paid will be offered or a date change; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered; if the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
If cancellation is by LA PONTEZUELA, SLU, the Customer will be offered a refund/date change or validation of a voucher. Change window: 6 months.
The Customer must communicate the presence of allergens at least 72 hours before the experience. Adaptation will be made subject to availability.
If cancellation is by LA PONTEZUELA SLU, the conditions set out in the body of the General Terms and Conditions of Contract shall apply.
B) One-off Experiences Subject to Conditions
3) Solar and Nebula Observation Workshop: The experience will be subject to weather conditions (thresholds at the discretion of the provider Orion Astronomía according to its reports) and a minimum of 12 attendees.
Conditions: Yes, subject to permissible weather and a minimum of 12 people.
Own equipment: not permitted.
Cancellation policy for this experience: If the Customer cancels more than 72 hours in advance or up to 72 hours before, a refund of the amount paid will be offered or a date change; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered; if the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
If cancellation is by LA PONTEZUELA SLU, the conditions set out in the body of the General Terms and Conditions of Contract shall apply.
4) G-Astronomical Experience: The experience will be subject to weather conditions (thresholds at the discretion of the provider Orion Astronomía according to its reports) and a minimum of 12 attendees.
Conditions: Yes, subject to permissible weather and a minimum of 12 people.
Own equipment: not permitted.
Cancellation policy for this experience: If the Customer cancels more than 72 hours in advance or up to 72 hours before, a refund of the amount paid will be offered or a date change; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered; if the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
If cancellation is by LA PONTEZUELA SLU, the conditions set out in the body of the General Terms and Conditions of Contract shall apply.
5) Wellness Day: This experience is subject to good weather conditions, a minimum age and a minimum number of participants.
Conditions: Yes, subject to permissible weather, a minimum of 15 people, and a minimum age of 14 years.
Cancellation policy for this experience: If the Customer cancels more than 72 hours in advance or up to 72 hours before, a refund of the amount paid will be offered or a date change; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered; if the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
If cancellation is by LA PONTEZUELA SLU, the conditions set out in the body of the General Terms and Conditions of Contract shall apply.
5) Escape Room: the escape room activity requires certain conditions for its performance.
Subject to: minimum of 15 participants; minimum participant age 7 years (minors must be accompanied at all times).
Cancellation policy for this experience: If the Customer cancels more than 72 hours in advance or up to 72 hours before, a refund of the amount paid will be offered or a date change; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered; if the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
Voluntary withdrawal by the Customer: non-refundable.
If cancellation is by LA PONTEZUELA SLU, the conditions set out in the body of the General Terms and Conditions of Contract shall apply.
6) Castilian–La Mancha Delicacies:
Cancellation policy for this experience: If the Customer cancels more than 72 hours in advance or up to 72 hours before, a refund of the amount paid will be offered or a date change; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered; if the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
LA PONTEZUELA, SLU reserves the right to remove Customers who do not behave properly during the experience and may disturb the relaxed atmosphere of the activity.
If cancellation is by LA PONTEZUELA SLU, the conditions set out in the body of the General Terms and Conditions of Contract shall apply.
7) The Bees Workshop: this experience will take the form of an outreach talk.
Experience conditions: subject to a minimum participation of 15 people.
No special equipment (PPE) is required.
Cancellation policy for this experience: If the Customer cancels more than 72 hours in advance or up to 72 hours before, a refund of the amount paid will be offered or a date change; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered; if the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
If cancellation is by LA PONTEZUELA SLU, the conditions set out in the body of the General Terms and Conditions of Contract shall apply.
8) Charity Gala: A fundraising dinner experience to support ASEM-CLM. Includes dinner.
Cancellation policy for this experience: If the Customer cancels more than 72 hours in advance or up to 72 hours before, a refund of the amount paid will be offered or a date change; if the Customer gives notice after 72 hours but at least 24 hours before the experience, a date change will be offered; if the Customer gives less than 24 hours’ notice or does not attend, no refund or date change will be offered.
Any allergens must be communicated at least 72 hours prior to the experience. Adaptation will be subject to availability.
9) From Madrid to La Pontezuela: LA PONTEZUELA, SLU may, optionally and at the customer’s request, offer a transport service to facilitate travel to the facilities where the experience takes place.
This service will be provided by duly authorised transport companies in accordance with current regulations, acting with full technical and organisational autonomy.
The cost of transport will be informed prior to contracting and must be paid in advance together with the experience reservation or at the time indicated in the confirmation.
Actual provision of the transport service corresponds exclusively to the contracted carrier, which shall be responsible for complying with the applicable regulations and holding the mandatory insurance in force.
In case of incident or accident during the journey, liability will be determined in accordance with current legislation on land transport and compulsory insurance, corresponding to the carrier and, where appropriate, its insurer.
The Company will not assume liability for damage resulting from acts attributable exclusively to the carrier, without prejudice to any rights the customer may have under applicable regulations.
